    Episode 2: Fair Fortune Part 1

    The Housing Department allows some decoration contractors to promote their business in newly completed public housing estates, to facilitate residents to renovate their new homes. However, some decoration contractors conduct market sharing and allocate designated floors among themselves for exclusive business. In addition, they agree not to compete with each other but share the market.

    The Competition Commission (The Commission) decides to take action after receiving complaints. Since the decoration contractors may not have fixed offices, it is difficult to search for evidence. The Investigation Team decides to assign Ashley (played by Jennifer YU) as the team leader to conduct home visits, to look for clues, hoping to obtain strong evidence. Johnny (played by Alan LUK) decides to participate in the action in person, so as to guide Nicole (played by LAM Chin-ting), the new team member.

    During the operation, Ashley and Sean (played by Himmy WONG) meet a drunk man who suddenly vomits during the interview. In order to protect his expensive suit from getting dirty, Sean dodges away from him, which upsets Ashley, and their mutually reinforcing trap remains.

    After consolidating the evidence provided by the residents, Johnny decided to interview the decoration contractors. They seems to have been well prepared for a long time, and they have “aligned their testimonies” to defend themselves. In fact, Big Lui (played by Marx CHEUNG), a veteran in decoration business, and his daughter Rachel (played by Rachel LEUNG) have long noticed the action of the Commission and already prepared countermeasures.

      The Competition Commission will send staff to exchange in Europe, which is a good opportunity to improve the chance of promotion and career development. Johnny decides to pick Ashley or Sean base on their work performance. In Johnny’s eyes, Ashley and Sean are his successors who possess different strengths, and they have always maintained healthy competition between them. He would like to reignite the competitive atmosphere between the two with the Europe exchange quota. Rookie Nicole becomes the lubricant between the two. Being all things to all men, Nicole helps Sean to apologise to Ashley, and she is a good listener when Ashley wants to confide her heart.

      The Healthy Food Company and Start-up Healthy APP Company are under investigation for suspected price fixing. The collection of evidence has just completed, then the people in charge of the two companies state that they admit liability and will assist in the investigation through their lawyers. Sean decides to close the file after interviewing WONG Yat-lung (played by Pierre NGO) from the Healthy Food Company. Johnny senses something unusual with the case as both companies admit liability readily, and he notices that Sean backs down intentionally for the sake of Ashley.

      On the other hand, Ashley feels suspicious after conducting interviews. She considers that the bosses of both companies are hiding something. Nicole points out that WONG Yat-lung’s wife Avis B (played by Inez LEONG) is a fitness Key Opinion Leader (KOL) who often webcasts live at the fitness centre concerned, and she suggests looking for clues therefrom. Ashley and Nicole check the relevant footage, and finally …

      Ashley is awarded the quota to exchange in Europe as she solves the case. Sean sends her his blessings, but there is something lingering in his mind. Johnny notices everything, while Nicole hopes that Ashley and Sean can make further progress.

      Carl (played by Bryant MAK) and Big Ma (played by LEE Sheung-ching) have been close friends for years. Both of them had been junior cooks at first, then they partnered to run a food factory. Although their partnership has already ended, they still have close business connections. Carl’s girlfriend Phoebe (played by Cheronna NG) always worries that Big Ma would take advantage of ingenuous Carl, and she keeps on reminding Carl to be aware of ill-intentioned people.

      Simon (played by Jason YIP) is the owner of an event planning company. He appreciates the quality food of the catering service provided by Carl and Big Ma, and his clients rarely complain about their service, so he always offers them business opportunities. Recently, Simon gets a commission from a sponsoring body to hold a large scale event. He then arranges for Carl and Big Ma to submit tenders for the catering service of the event, and asks the two to firm up the tender price in order to avoid the tender being awarded to someone else. However, they do not notice that they have contravened the clause of “exchanging competitively sensitive information” under the Competition Ordinance.

      Sean and Ashley still have a strained relationship after the estate resident vomit incident when they were collecting evidence last time. Sean decides to bribe Nicole to collect information for him, but the price is much higher than expected.

      Carl is angry when he realises that Big Ma deceives him to snatch the business, and it adds fuel to the fire when he knows that Phoebe is injured being pushed by Big Ma to the ground. Conflict between the two friends is unavoidable. The Competition Commission has so-called “leniency policies” that if someone is involved in an anti-competitive conduct and is the first to report, he / she will be absolved from proceedings. So, who will sell his friend out?

      Sean seeks advice from Johnny, and Johnny tells him to “avoid tailgating”. Nicole learns that Ashley broke up with her ex-boyfriend two years ago. She thinks that Sean can be more aggressive, but she is more of a hindrance than a help …

      We now rewind to more than 20 years ago, when a new housing estate had just been completed. Disputes and even fights broke out among the decoration contractors when they competed for business. Subsequently, Big Lui stepped forward and told everyone the importance of harmony and they allocated designated floors among themselves to do their own business. These decoration contractors are very satisfied with this “pie sharing” practice, and they have been using this self-coordination mechanism since then.

      Just when the Investigation Team is about to prosecute the decoration contractors, it receives a complaint from a resident of another newly built public housing estate against the decoration contractors, for their conspiracy to allocate designated floors among themselves for market sharing, and Big Lui’s company is also involved.

      After receiving the charge sheets, the decoration contractors discuss their countermeasures together, and they cannot agree on whether they should to enter a lawsuit. In fact, Rachel has already consulted her friend who is a lawyer, and they are not optimistic about the lawsuit. However, Rachel still cast an affirmative vote, and Big Lui is disappointed with his daughter’s decision.

      The decoration contractors plead not guilty, arguing that they are doing it for economic benefit / efficiency and for the sake of convenience of the residents. The Investigation Team of the Competition Commission continues to search for evidence perseveringly. In the end, the court finds that the decoration contractors are guilty of contravening the Competition Ordinance. Subsequently, the Housing Department also implements a series of new measures to prevent similar incidents from happening again.

      Nicole SHUM, a newly recruited Competition Affairs Officer (Investigation), senses an unusual ambience at the very moment she enters the office – as the two Managers (Investigation) of the Commission Ashley YEUNG and Sean SUNG always compete secretly, Nicole finds herself caught in a dilemma.

      At a lecture on anti bid-rigging, Ashley and Nicole receive a complaint on suspected bid-rigging. The complainant indicates that his company has issued invitations to tender for the purchase and installation of a storage system, and he suspects that his company has received tenders with suspected problems. Nicole finds something suspicious in the documents, and that changes Ashley’s impression of her.

      Ashley reports to her supervisor Johnny LAM, Head of the Investigation Team of the Competition Commission, that suspicious signs are found in a few tenders, and she has reasons to believe that a number of information technology companies have contravened the Competition Ordinance. The Investigation Team investigates and collects evidence from the 4 information technology companies suspected to have participated in bid-rigging. After thorough and difficult investigations, it finds that the key figure turns out to be another person…

      At the end, the parties participated in bid-rigging are convicted by the Competition Tribunal for contravening the first conduct rule of the Competition Ordinance, with fines imposed and costs awarded against them.
